Colombia interrupts the entry of lawsuits to face the Viva Air and Ultra Air crisis

Specifically, this strategy seeks to address the more than 34,300 lawsuits that were filed during 2023 as a result of the cessation of operations of both low-cost companies.

The Superintendency of Industry and Commerce (SIC), the government body in charge of ensuring the proper functioning of markets in Colombia, has agreed on a judicial decongestion plan to evacuate the avalanche of lawsuits presented by those affected by the Viva airlines crisis. Air and Ultra Air.

Specifically, this strategy seeks to address the more than 34,300 lawsuits that were filed during 2023 as a result of the cessation of operations of both low-cost companies, which entered into restructuring and bankruptcy processes last year.

The 'Comprehensive Judicial Decongestion Plan: towards a prompt, timely and effective administration of justice in the SIC' aims to guarantee that users have a short-term response to their demands for justice in matters of consumer protection, industrial property and unfair competition.

The strategy provides for the suspension of judicial terms between April 24 and June 10 of this year. During this period, the 62 officials who are in charge of exercising jurisdictional functions will have the mission of evacuating demands on this matter.

These types of measures have been taken on several occasions in the past due to failures in the technological platform, process inventory and insufficient personnel.

The suspension of terms implies that the channels for filing consumer protection, unfair competition and industrial property claims, such as the website or virtual window, among others, will be temporarily disabled until the resumption of said terms.

However, during this period, users who feel their rights have been violated may go directly to the ordinary courts to present their claims, as explained by the Superintendency.
