On August 23, the United States Trade Representative activated the Rapid Labor Response Mechanism (RLRM) alleging a possible denial of freedom of association and collective bargaining rights at Pirelli Tires.
The Mexican government will conduct an investigation into Pirelli, the second largest tire company accused of denying labor rights to workers at its plant in Silao, Guanajuato. The results will be released in approximately 30 days, and will be delivered to the United States government within the framework of the T-MEC.
On August 23, the United States Trade Representative activated the Rapid Labor Response Mechanism (RLRM) alleging a possible denial of freedom of association and collective bargaining rights at Pirelli Tires.
In accepting the request, the Ministry of Labor and Social Welfare announced that it will conduct an internal review within 45 days from the date the request was received to determine whether there has been a denial of rights at the Pirelli company.
The Mexican government reiterates its commitment to effectively implement labor legislation, as well as the provisions on the matter established in the T-MEC, thereby guaranteeing compliance and protection of the collective rights of the country's workers."
The Pirelli workers have followed the same path as the Goodyear tire workers, who demonstrated that the Contract Law was not being applied in this company, and on the contrary there was a collective labor contract with lesser benefits, and after a labor complaint, the Contract Law is now being applied with benefits for the workers.
However, in the case of Pirelli, the union organization that currently supports the collective agreement, not the Legal Contract, managed to negotiate with the company to "harmonize" the workers' benefits with the Legal Contract, in cases such as the payment of bonuses and the working day.
Tereso Medina, general secretary of the Miguel Trujillo Union, signed the agreement at the Federal Center for Conciliation and Labor Registration (CFCRL) and stressed that “with the signing of the Collective Labor Agreement, whose negotiations began in March of this year, the CTm union is taking a step forward, since workers will have better working conditions.”
